Welcome to TEMOTIVA. Please read the following Terms and Conditions (hereinafter, "T&C") carefully, as they govern access to and use of our platform and services. Acceptance of these T&C constitutes a legally binding adhesion contract between you (the User) and TEMOTIVA INNOVACIÓN LAB, S.L.
1. Nature of the Service and Medical Disclaimer
TEMOTIVA is a healthtech platform focused on preventive emotional wellbeing and self-care education. Under no circumstances do the services, content, or tools provided through the platform constitute or replace medical, psychological, psychiatric, or therapeutic diagnosis or treatment. In the event of a serious emotional crisis or risk to health, the User must seek qualified healthcare professionals or the relevant emergency services.
2. Minimum Age and Legal Capacity
To register and use TEMOTIVA's services, the User must be at least 14 years of age. By accepting these T&C, the User warrants that they meet this minimum age requirement. Access to the platform or subscription to paid services by a person under 14 without the required legal capacity or without the consent of their legal guardians renders the contract voidable and will result in immediate account cancellation and deletion of data.
3. Subscription Plans and Features
TEMOTIVA offers its services under two main plans: a free plan (Freemium) and a paid plan (Premium).

4. Pricing and Modification of Terms
TEMOTIVA reserves the right to modify subscription prices or these T&C. However, any price increase or material change will be notified to the User at least 30 days in advance before it takes effect. During this period, the User will have the right to cancel their subscription before being charged the new rate.
5. Trial Period, Renewal, and Payments
For paid subscriptions, TEMOTIVA may offer a 14-day free trial period.
- Automatic conversion: Once the trial period ends, unless the User cancels beforehand, the subscription will automatically convert to a paid subscription and the corresponding charge will begin.
- Confirmation: After the subscription transaction, TEMOTIVA will send a purchase confirmation email.
- Subsequent cancellation: Except where legal withdrawal rights apply, cancellation of the subscription will take effect at the end of the current billing period, with no refund for amounts already paid for the unused portion of the period.
6. Right of Withdrawal
Under Royal Legislative Decree 1/2007 (Spanish General Law for the Defence of Consumers and Users), the User has a statutory period of 14 calendar days from the date of contracting to exercise their right of withdrawal without giving any reason.
- Where a 14-day free trial period is offered, this period coincides with the statutory withdrawal period, so the User may cancel at no cost.
- If the User contracts a paid subscription directly (without a trial period) and expressly requests immediate commencement of the service, they expressly acknowledge and accept that they will lose their right of withdrawal once the contract has been fully performed.
- To exercise this right, the User may use the Withdrawal Form included as Annex I to these T&C or communicate their decision by any other legally permitted means.
7. Conformity of Digital Services
In accordance with Royal Decree-Law 7/2021 and Directive (EU) 2019/770, TEMOTIVA guarantees that the digital services supplied are conforming to what was contracted, match the description and features communicated, and will receive the updates necessary for proper operation during the term of the contract. In the event of non-conformity, the User has the right to demand the corrective measures provided by law.
8. Technical Disclaimer and Limitation of Liability
TEMOTIVA endeavours to keep the platform available and free of errors. However, it shall not be liable for service interruptions, lack of availability, or damage arising from technical failures beyond its control, force majeure, or improper use of the platform by the User.
9. Privacy and Data Protection Officer (DPO)
Processing of the User's personal data is governed by our Privacy Policy. To ensure maximum protection and regulatory compliance (GDPR and LOPDGDD), TEMOTIVA has appointed a Data Protection Officer (DPO), Andrea Giorgi Casce. The User may contact her directly regarding any matter relating to the processing of their data by writing to: dpo@temotiva.com.
10. Jurisdiction and Dispute Resolution (ODR)
These T&C are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts and tribunals corresponding to the consumer's place of residence. Furthermore, in compliance with Regulation (EU) No 524/2013, we inform the User that the European Commission provides an Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr/.
